Legal Issues for the Contemporary Artist

Broward County Commission’s Cultural Division, ArtServe, Inc., and the South Florida Artists Association will present Legal Issues for the Contemporary Artist with the Associate Director of Volunteer Lawyers for the Arts, Sergio Muñoz Sarmiento, Esq. This is a unique set of training sessions to assist individual artists working in all disciplines.

The half-day seminar for arts professionals will cover the legal and business issues that affect individual artists and professionals within arts and cultural organizations. This is a course for artists of all disciplines, including visual artists, performance artists, writers, fashion designers, filmmakers, musicians, web designers, and anyone working in interactive media. Also, cultural organizations, recently admitted attorneys and other professionals who represent artists, should also benefit from this program.

“Legal issues can be overwhelming for many visual and performing artists: relationships with galleries, appropriation practices, damaged artwork, art world employment practices, fundraising for projects, and collaborations with other artists are just some of the issues visual artists face,” says Sarmiento. With this in mind, Volunteer Lawyers for the Arts has structured a half-day workshop for contemporary artists that will make legalese comprehensible and manageable, while giving visual artists an introduction to legal issues necessary to protect themselves and their art projects. This half-day workshop will cover intellectual property (copyright and trademarks); contracts and consignment agreements; basic business models (non-profit and for-profit corporations, LLC’s, fiscal sponsorships); employment issues with studio and gallery assistants; artist websites.

Sergio Muñoz Sarmiento, Esq., is currently the Associate Director for Volunteer Lawyers for the Arts in New York City, where he advises and represents visual and performing artists and arts organizations. He received his BA in Art from the University of Texas-El Paso, and an MFA in Art from The California Institute of the Arts. In 1997 he was a Van Lier Fellow at the Whitney Museum’s Independent Study Program in Studio Art, and received his J.D. from Cornell Law School. He is an Adjunct Professor of art law at Fordham Law School, and is also the Program Director and faculty of VLA’s Art & Law Residency Program. His legal experience includes advising artists, galleries, and arts organizations on matters involving copyright, trademarks, moral rights, free speech, and artist-gallery disputes. He has recently worked on an important appeal under the Visual Artists Rights Act of 1990 on behalf of the Swiss installation artist Christoph Büchel in the artist’s highly-publicized dispute with the Massachusetts Museum of Contemporary Art.

Life Is Art Creative Connections #13 at Sol Gallery at CANDO Arts Co-op on Tuesday, May 17, 2011.

The Law Office of William Peña Wells is a South Florida civil practice firm that offers a full range of legal services to a diversified client base, including arts and entertainment clients, The firm provides strategic marketing advice, licensing, contract negotiation and review to individuals, corporate clients, and nonprofit agencies in the United States and Europe. Mr. Wells sits on several nonprofit boards and is Legal Counsel to Artists for A Cause, a South Florida nonprofit group dedicated to providing opportunities for artists to contribute to social causes.

This seminar focused on the legal issues facing artists, particularly contracts. We know many artists who have been ripped off because they did not understand, or even read, the contracts they signed. Do not lose your art! This is a serious issue and one we are going to tackle for this seminar. Mr. Wells is going to break it down and give you some simple examples of how you can protect yourself. Mr. Wells understands these issues very well, being both a lawyer and an artist. Please bring any other legal questions you may have and we will try to cover as many as possible.

BROWARD COUNTY, Fla. – Broward County Commission’s Cultural Division, Nova Southeastern University, and the South Florida Artists Association will host a unique training session to assist individual artists, working in all disciplines, with preparing effective proposals for “project-based” grant funding.
The workshop will be held at Room 4009 – Alvin Sherman Library, Research, and Information Technology Center, Nova Southeastern University, 3100 Ray Ferrero, Jr., Blvd., in Fort Lauderdale, on Saturday, May 14, 2011, 9:00AM – 1:00PM.

Participants will learn how to: develop an artist’s biography and artist’s statement; Prepare an audience profile (identify the qualities and characteristics of audiences attracted by one’s art work and utilize the profile in the proposal process); Create a proposal description based on the project’s vision; Develop a project/proposal budget (w/case study to explore the budget development process); Preparing work samples. This workshop will help artists plan and prepare successful proposals for residencies, project funding, professional development, career advancement, and fellowship opportunities.

In addition, the session will prepare Broward artists who wish to learn how to prepare a submission to the Creative Capital professional development seminar: Internet for Artists Weekend Workshop: Using the Internet to Build Community, Promote Your Work and Increase Administrative Effectiveness and the Division’s Mini-Grant Program project grant for Broward artists. Broward artists will submit proposals to both opportunities by an online application and will be chosen by a competitive review and panel process.

The facilitator, Luz Rodriguez with Visionary Allies, is a seasoned fundraising professional, educator, and artist who combines her artistic sensitivities with her knowledge of U.S. philanthropy to guide and inspire artists of all genres to equip them with the information and tools they need to bring their project visions to reality. Her professional development workshops for artists have been offered nationally and internationally at Artist Space in New York and Centro Leon Cultural Center in the Dominican Republic. Ms. Rodriguez has more than 20 years of fundraising, coalition building and organizational development experience in advocacy and social justice movements. She has held staff and board leadership positions in community-based organizations in the fields of reproductive justice of women of color; youth development; hunger and homelessness. Her oral history and papers are included in the Voices of Feminism archival project at the Sophia Smith Collection at Smith College. She is currently a bilingual training coordinator, at the Foundation Center, NYC, where she is responsible for designing and implementing fundraising training programs with a special focus on delivering English and Spanish training to under-resourced, grassroots organizations.

Broward County Cultural Division invites Broward-resident artists of all disciplines and creative endeavors to attend the next informational meeting on May 5, to learn about the application process for Creative Capital’s transformative seminar- Internet for Artists Weekend Workshop: Using the Internet to Build Community, Promote Your Work and Increase Administrative Effectiveness. Twenty-four Broward County artists, will be selected through a Call to Artist application process to attend the Creative Capital Seminar in November.

The Broward Cultural Division is one of nineteen national recipients of the 2011 Workshop Subsidy Grants from Creative Capital’s Professional Development Program (PDP) to present this seminar locally. To be considered, Broward artists will be submitting proposals to participate in the seminar by an online application. Participants will be chosen by a competitive review and panel selection process. The Division is delighted to be able to offer 24 Broward artists this one-time opportunity to train with Creative Capital’s faculty. These information sessions will prepare Broward’s performing and media artists, writers, musicians, dancers, and visual artists for this opportunity.

The CANDO Arts Co-op is a contemporary Art Center in Miami Beach that was founded by Ray Breslin, president of Collins Park Neighborhood Association(CPNA) in November, 2009. CANDO, which stands for Cultural Arts Neighborhood Districts Overlay, is in the Collins Park neighborhood.

The thought-provoking work of the 10 resident artists and guest artists is showcased in 5000 square feet of gallery space. The historic building, known as Palm Court, was previously occupied by the W Hotel’s administrative offices, which converted perfectly into a main gallery space, and smaller rooms for studios or private exhibition spaces flanking the main gallery. The main gallery space named Sol Gallery, is used for rotating exhibits comprised of member shows, open calls, classes, and for special events.

The Palm Court building has recently been opened up further to include the Howard Austin Feld gallery, and Art 33139 which was founded and is directed by Tiffany Levy.

You probably do not understand Copyright. Almost nobody does. It is a commonly misunderstood law and does not work the way most people think it does. Faudlin is going to break it down for the non-lawyer. This is VERY important information for all artists and anyone involved in the creative process. This seminar will give you a much better idea about how copyright works, what it protects, and what it does not protect.

Faudlin Pierre Bio:
Faudlin Pierre is a South Florida native. He received a bachelor of science in business administration from the University of North Carolina-Chapel Hill and his law degree from the University of Kentucky. He is admitted to practice law in the state of Florida and his admission is pending with the United States Southern District Court of Florida. Mr. Pierre litigates and transacts on behalf of his clients. He has written legal articles for Sports Business Journal, negotiated sponsorship agreements with companies such as Nike & Adidas, and has advise various athletes on the legal repercussions of their potential actions.
